United States District Court for the NMI Presiding Judge Alex R. Munson also placed Xiao Feng Li on three-year probation after her release.
She will be delivered to an authorized immigration officer for deportation proceedings after serving her jail term, but if deportation fails to occur she will immediately report to the U.S. Probation Office.
She must not commit another federal, state or local crime, not possess a controlled substance and must submit to a drug test within 15 days of release from jail.
This should be followed by two periodic drug tests thereafter.
She is prohibited from possessing firearms or dangerous weapon, and must submit to a collection of a DNA sample at the direction of the U.S. Probation Office.
Moreover, she must perform 200 hours of community service.
The federal court waived all fines except a special assessment fee of $100 which she must pay immediately after sentencing.
After the hearing, the defendant was remanded to the custody of the U.S. Marshal Service.
The defendant appeared for the sentencing with her court-appointed counsel Matthew Smith. Assistant U.S. Attorney Erick O’Malley represented the federal government.
The defendant was indicted for one count of possession with intent to distribute a controlled substance. The indictment stated that on April 12, 2008, the defendant was caught in possession of 0.76 net gram of ice on Tinian. She entered a guilty plea to the charges on Aug. 21.
