The man who suffered lacerations in his head was hospitalized for 10 days.
The men who assaulted him with a 2×2 and 2×4 lumber were both charged on April 10 with one count of assault and battery with a dangerous weapon and one count of attempted aggravated assault.Robert Padron and Ruben Santos appeared in court on Friday, April 17 and waived reading of the information.Padron and Santos entered a not guilty plea to their charges.The defendants posted $500 surety bonds and were released from the custody.The court ordered them to stay away from the victim.The status conference is set for May 29 at 9:45 am.The police affidavit submitted in court stated that the incident happened on October 10, 2008 at the Hanpa barracks in Ngerbeched.The court document stated that police responded to a report of disturbance in Ngerbeched.The document stated that initial investigation revealed that Padron and Santos were engaged in drinking spree at the Hanpa barracks when Padron decided to urinate in front of the victim’s open door.The affidavit stated that victim confronted the defendant and asked him why he did not use the rest room.The document stated that Padron grabbed the victim’s shirt and pulled him out of the door.Then the Padron and Santos started attacking the victim with a 2×2 and 2×4 lumbers.The affidavit stated that defendants “beat the victim until he is bleeding and unconscious on the ground.”The document stated that victim sustained eight stitches for his three inches lacerations in the head.
