HAGÅTÑA (The Guam Daily Post) — A man was accused of punching a man and a woman in Mangilao.
On Sunday, Guam Police Department officers responded to a Mangilao residence for a request to remove an individual who was later identified as Malik Baham, 30.
According to the magistrate’s complaint filed in the Superior Court of Guam, when officers arrived, they were told Baham had left the residence but returned reportedly armed.
Baham was then approached by officers and was compliant with their instructions. Police were unable to find any weapons after searching Baham.
According to the complaint, Baham accused four women and one man of assaulting him.
“(The) defendant had arrived to the residence to pick up his wife and children. (The) defendant and his wife argued and (the) defendant left, but then returned. (The) defendant was observed to be intoxicated by those at the residence and was told to come back the next day to pick up his family. (The) defendant insisted to take his children and (the) defendant and those at the residence argued,” the complaint stated.
During an interview with a witness, officers learned Baham approached a woman in an “aggressive” manner before punching the woman. The witness also reported Baham punched a man who was trying to intervene in Baham’s physical altercation with the woman.
The complaint stated the male and female victims’ statements corroborated with the witness’ statement. The man and woman were observed to have red and swollen bruises on their cheeks and abrasions to their hands and knees.
A second witness, a woman, however, approached the police and told them “everything was OK” and “begged” them not to speak with the others at the residence. The witness further stated the others were drunk and assaulted Baham first.
“During her interview, she stated the defendant was slapped by Victim 1 first,” according to the complaint.
In Baham’s interview with GPD, he waived his Miranda Rights at the Dededo precinct and admitted he drank alcohol before arriving at the Mangilao residence to take his family home and that he did argue with his wife.
“He stated those at the residence told him to get off the property, so he left, but went back to get his family. He heard them call him names, and he continued toward the residence despite the continued statements for him to leave. He heard a male voice threaten to punch him, and he threw a punch and hit an unknown male. He felt a punch to his face (and) that scooters were used to hit him, and he continued to punch multiple people,” the complaint states.
Officers noted Baham smelled of alcohol, had bloodshot watery eyes, slurred speech and had injuries to his forehead and swelling on his lower lip and right cheek.
Baham was charged with two counts of misdemeanor assault.
