A GRAND jury has indicted Dwight Lee Deleon Guerrero Aldan on the charge of possession with intent to distribute more than 50 grams of methamphetamine.
According to the indictment, Aldan, on or about Dec. 22, 2020, “knowingly and intentionally possessed with intent to distribute more than 50 grams of methamphetamine, a Schedule II controlled substance, in violation of Title 21, US Code, Sections 841 (a)(1) and (b)(l)(A)(viii).”
No other details about the case were available as of press time Wednesday.
Aldan appeared in the custody of the U.S. Marshals before District Court for the NMI Chief Judge Ramona V. Manglona for the initial hearing on Wednesday.
Aldan, through court-appointed attorney Steven Pixley, waived the advisement of his constitutional rights and the reading of the charge against him.
Aldan entered a plea of not guilty.
Assistant U.S. Attorney Albert Flores, who appeared for the federal government, moved for a detention order pending trial.
After hearing from the parties, Aldan was remanded to custody, and Judge Manglona scheduled a detention hearing for May 24 at 2:30 p.m.
As required by Rule 5(f) of the Federal Rules of Criminal Procedure, Judge Manglona ordered the U.S. government to produce all exculpatory evidence to the defendant “pursuant to Brady v. Maryland and its progeny.”
She said not doing so “in a timely manner may result in sanctions, including exclusion of evidence, adverse jury instructions, dismissal of charges and contempt proceedings.”
The judge also set the jury trial for July 27, 2021 at 10 a.m. She said pretrial motions shall be filed no later than June 2, and motions in limine, if any, shall be filed no later than June 25.
According to an online legal dictionary, a motion in limine is “a pretrial motion asking that certain evidence be found inadmissible, and that it not be referred to or offered at trial.”
