Court reduces bail for man who threatened to kill family

Associate Judge David A. Wiseman allowed David P. Diaz Jr., 28, to post $500 cash, representing 10 percent of the $5,000 bail imposed on him.

Diaz was released to a relative as his third party custodian.

Assistant Attorney General Eli Golob is prosecuting the case while Assistant Public Defender Adam Miles represents Diaz.

Diaz is being held on charges of assault, disturbing the peace, criminal contempt, and violating an order of protection, when he contacted his wife through telephone on Dec. 10, 2010.

The wife stated that her husband was “planning to kill her and their children and then commit suicide,” according to Detective Peter Aldan.

Judge Kenneth Govendo issued on July 28, 2010 a one-year order of protection against Diaz.

The court allows Diaz to call his wife but “only if its concerning his minor children,” Aldan said.
