Obak has admitted charges of sexual abuse in the second degree as a lesser included offense, and assault and battery.
According to the factual basis for plea, Obak engaged in sexual contact with his victim, and choked her on Dec. 12, 2008.
At that time, the victim was walking along the Beach Road jogging pathway, at about 7:10 p.m., near the Oleai Beach Bar & Grill, when Obak pushed her forward to the ground, police said.
When the victim fell, Obak touched her private parts, groped her breast, and stole her money, police said.
Judge David A. Wiseman originally sentenced Obak to six years’ imprisonment, all but suspended 33 months, and credited time he already served in prison. For the assault and battery, the court imposed one year imprisonment, all suspended but 45 days with credit for time served.
On Nov. 2, 2009, the Superior Court ordered Obak’s deportation “forthwith” from the commonwealth. It was not immediately ascertained if U.S. Department of Homeland Security has initiated Obak’s removal proceedings.
In accepting the plea, Wiseman recognized that the victim was spared from public testimony.
The prosecution asked the court to dismiss the remaining charge which the court granted. The Attorney General’s Office charged Obak with sexual assault in the first degree, robbery, and assault and battery.
The court ordered Obak to pay a $250 fine, a $100 assessment fee, and a probation fee.
Obak will not have any contact with his victim. Obak will pay restitution in an amount to be determined by the Adult Probation Office to the victim.
