Rios gets 1 year for assault, ‘ice’ possession, violation of probation

The assault occurred last year, while the drug case happened last May.

For the “ice” charge, Govendo sentenced Rios to one year imprisonment, with credit for 114 days already served at the Department of Corrections facility.

For the assault charge, Rios was sentenced to one year in prison, all suspended except for three months, and with credit for time served.

This sentence will run concurrently with that of the “ice” case.

Rios’ violation of probation will be tolled during his incarceration, and will begin upon his release from prison for the “ice” case.

Rios will be placed on three years’ probation.

He will pay a $2,000 fine, and other fines, fees, or penalties imposed by the court.

Rios will also write a letter of apology and will stay away from his victim. He will pay  restitution to be determined by the Attorney General’s Office’s victim advocate and will undergo counseling at the Community Guidance Center as well as complete any recommended course of treatment.

Assistant Attorneys General Peter Prestley and Eileen Escudero Wisor prosecuted the case, while attorney Glenn Jewell and Assistant Public Defender Douglas Hartig served as counsels for Rios.

Last May, former Detective Sean White said police were on routine patrol in Koblerville near KL Market when they saw a vehicle in the parking lot, believed to be operated by Rios, who was already wanted by police at that time.

Before authorities could reach Rios, the vehicle exited the parking lot and stopped at the defendant’s residence, also in Koblerville, police said.

There, the authorities talked to Rios who consented to a search of his vehicle, where a pouch was found. Inside the pouch was “a clear plastic pipe typically used for smoking ‘ice.’”

Also found was a cut-off white straw with a crystalline substance on the passenger side of the vehicle.

A field test showed that the straw and pipe tested presumptive positive for the presence of “ice,” police said.

Early this year, the Superior Court ordered Rios to serve his 14-day jail term for theft.
