How to avoid Fair Labor Standards Act violations

The lunch meeting will be held at the Pacific Islands Club-Charley’s Cabaret on Thursday, March 31, from 11:30 a.m. to 1:30 p.m.

This presentation is open to the public and will be an invaluable opportunity for employers and employees to learn more about the application of the Fair Labor Standards Act in the CNMI.

The FLSA was originally passed into law in 1938 and sets the minimum wage, requires “time-and-a-half” for overtime in certain jobs, and prohibits most employment of minors.

The FLSA applies to almost all employees unless an employer can claim an exemption from coverage.

Wang and Tenorio will provide an overview of the FLSA and discuss important topics such as:

1) What is the Fair Labor Standards Act and how does it affect my business and employees?

2) What are the most common FLSA and compensation violations in the CNMI and Guam?

3) Who is exempt from the FLSA?

4) When is the CNMI minimum wage going up again and what minimum wage do I have to pay now?

5) What are legitimate deductions from employee wages and what must employees be paid for?

6) How should automatic service charges by employers be distributed to employees (i.e., waiters/waitresses)?

7) What are the consequences of violating the FLSA?
