Frances M. Tydingco-Gatewood, the designated U.S. District Court judge for the NMI, said she reviewed Pangelinan’s latest filings and concluded that they failed to comply with court rules and should not be docketed.
“These documents come under the scope of Review Order, but fail to comply with it in at least three ways. Plaintiff did not include (1) a motion for permission to file these documents, nor (2) a copy of the Review Order, nor (3) proof of full payment of all monetary sanctions previously imposed by a judge of this court in any matter referenced in the Review Order,” Tydingco-Gatewood wrote in her order. “The Clerk of Court is directed to destroy these documents and all copies thereof.”
Pangelinan filed a $61.6 million civil lawsuit against then-U.S. District Court for the NMI Chief Judge Alex Munson and designated Federal Judge David Wiseman, among other defendants, in relation to a 1997 case in which he was ordered to pay $270,000.
Last year, the U.S. Ninth Circuit Court of Appeals affirmed Tydingco-Gatewood’s decision dismissing Pangelinan’s case against the judges and declaring him a vexatious litigant.
Tydingco-Gatewood then issued a Review Order stating that Pangelinan may not file in the federal court “any complaint, motion, petition notice, or other paper document, however styled, that is related in any way to any matter referenced in the Review Order” — unless a judge first determines that the document meets certain requirements.
These include a motion for permission to file the document, a copy of the Review Order, proof of full payment of all monetary sanctions previously imposed by a judge in any matter referenced in the Review Order, cash full filing fee and two copies of the document.
