Man in auto accident sues driver

The complaint was filed by Conrado M. Torio against Mary L. Blaluk.

Torio, through attorney Eric S. Smith, is asking the court to order the defendant to pay him for the cost of suit and attorney’s fees, for past and future medical expenses at an amount which can be determined at trial, physical damages, for lost wages, damage to automobile, and other relief as the court deems proper.

According to his complaint, Torio was driving a blue Toyota at around 6:45 p.m. on Dec. 22, 2006 on Beach Road Garapan heading south.

He said he came to a complete stop when he saw a vehicle stop ahead of him.

The defendant, who was also heading south and driving a black Kia, hit his rear end, causing an accident.

The plaintiff said the impact hit him with force and caused him injuries and pain.

His complaint stated that Blaluk “carelessly and negligently drove, maintained and operated the Kia without regard for the safety of other persons.”

Blaluk, the complaint added, “failed to put a prudent distance and operated the vehicle at a rate of speed which was in excess of that is allowable in that area.”

Moreover, she “failed to use ordinary care and failed to exercise all of the means available to avoid the collision,” the complaint stated.

Torio said as a result of his injuries, he was required to undergo medical treatment and incurred expenses for the hospitalization.

 He was unable to return to work as a result of the accident, hence, he said, he is entitled to compensation for lost wages.
