Associate Judge David A. Wiseman placed Adrian Baculod on probation for six months and ordered him to pay a $200 fine and a $25 assessment fee.
He must write a letter of apology and have no contact with the victim.
He must also undergo guidance counseling, seek and maintain full time employment, and not leave the CNMI without court permission.
He must obey all CNMI and federal laws, and render 30 hours community work service.
Wiseman set the review hearing for March 11, 2009 at 9 a.m.
Baculod, who was facing assault and battery charges, entered into a plea agreement with the commonwealth through the assistance of his counsel, Assistant Public Defender Attorney Matthew Holley. He pleaded guilty to the lesser offense of assault. Assistant Attorney General Rebecca Warfield represented the government.
Detective Andrea C. Ozawa in her affidavit stated that police officers who were on routine patrol at about 1:15 a.m. on April 20 noticed a vehicle parked at Susupe Regional Park with the lights on.
When the police officers checked the vehicle, the driver who was later identified as the defendant rolled down his window and told the police he was having an argument with his wife.
The officers heard a female voice yelling for help so they ordered the defendant to park the car.
The defendant, however, drove out of the exit.
The police officers were forced to activate the siren and gave pursuit. As the police vehicle approached the vehicle, a female passenger with blood all over her face rolled down the window and told the police her husband beat her up.
The officers called medics to treat the victim’s injuries.
Preliminary investigation showed that the victim was at Club V at about 1 a.m. when the defendant told her to get into his car so they could go home, but instead of driving home, the defendant took her to Susupe Beach Park and started punching her face.
She yelled for help but he pulled her out of the car and punched her again.
She said the defendant ordered her to be quiet when she spotted the police car.
The defendant was arrested and taken to the Department of Corrections where he was booked and detained. The victim sustained lacerations on her face from the beating she received.
