Marco Selepeo Fitial, 28, was charged with disturbing the peace and assault with a dangerous weapon.
Fitial appeared before Associate Judge Kenneth L. Govendo on Monday and represented by Assistant Public Defender Richard Miller.
Assistant Attorney General Brian D. Gallagher appeared on behalf of the government.
If he posts bail, the defendant must return to court whenever required to do so, obey all commonwealth laws, surrender his travel documents and not leave the CNMI without court permission, provide the court with a sketch of his residence , and must have no direct or indirect contact with his sister, his sister’s husband and children.
Govendo set the preliminary hearing for June 30 at 1:30 p.m. and the arraignment for July 6 at 9 a.m.
In his affidavit, Detective Vince S. Salas said police received a call reporting a disturbance incident at a residence in Chalan Laulau at about 3 p.m. on June 11.
Salas said Genevieve Rahman told the responding police that the defendant, who was her brother and who was drunk at that time, assaulted them with a stick.
Police noticed a bruising on Rahman’s elbow and a bleeding scratch on her forearm.
Rahman’s husband also sustained a wound on his forehead.
Police arrested the defendant and transported him to the Department of Corrections for processing.
Further investigation showed that the defendant arrived at the house of the victims at about 3 p.m. on June 11 already drunk but was still drinking liquor.
The defendant was going around houses chasing children and getting mad at them for no reason.
He was also challenging people to fight.
The defendant then walked toward their house, picked up a long wooden stick and asked his brother-in-law if he wanted to get hit with the stick.
When Rahman interfered, the defendant hit the couple with the stick.
