1-year sentence for family violence, violating court order

HAGÅTÑA (The Guam Daily Post) — A man will serve one year in prison for misdemeanor charges of family violence and violation of a court order.

On Tuesday morning in the Superior Court of Guam, Jay Boi Elias appeared to be sentenced for 2022 convictions of family violence and violation of a court order as misdemeanors.

Elias was found guilty of the charges by a jury in November 2023. The charges stemmed from Elias assaulting a woman in October 2021 and stealing her belongings in February 2022. Court records at the time indicated Elias was ordered to stay away from the woman.

After being found guilty, the Office of the Attorney General said it would seek the maximum sentence of two years, which prosecutor Sean Brown argued for during the sentencing hearing.

Brown said in his argument that the maximum sentence was necessary not only because of Elias’ violent history, but for the safety of the community and deterrence.

Additionally, Brown said Elias has continued to victimize the woman in the case and was charged in 2023 with kidnapping the same victim.

Elias’ attorney, Terrence Timblin, said he wanted to focus on what Elias had been convicted of, rather than his criminal history, and requested Elias be sentenced to 60 days in prison.

Timblin also referred to the woman’s testimony at Elias’ trial, where she said there was a possibility that she will maintain a relationship with Elias, which led Timblin to believe she was not “totally traumatized” by Elias’ actions.

When asked if he would like to give a statement before being sentenced, Elias elected not to.

Presiding Judge Alberto Lamorena III subsequently sentenced Elias to one year with six months suspended for each of the charges of family violence and violation of a court order, which adds up to a one-year prison sentence.

Upon release, Elias will be on probation for two years. Elias also was ordered not to contact the victim in the case.

Kidnapping

In April 2023, Elias was charged with kidnapping, terrorizing and aggravated assault after the victim in the family violence case reportedly told officers with the Guam Police Department that Elias had been terrorizing her for months.

According to court documents, the woman was leaving a friend’s house when Elias dragged the woman into his car by her hair and repeatedly slapped her as she tried to get away.

Elias at one point forced her to put a blindfold on while he drove and threatened to “shoot her whole face off” if she didn’t do what she was told. Elias allegedly drove around with the victim before he took her to his house and kept her there for a week to allow her injuries to heal.

After Elias released the woman, however, he followed her and on April 18, “he got into her car, pointed a gun at her and threatened to kill her if she didn’t give him her cellphone,” the complaint alleged.

The woman told police she gave her cellphone to Elias, and he got out of her car.

Elias faces a maximum of 35 years in prison for the kidnapping charges, according to the AG’s office.
