The deadline of filing was continued to April 2, 2010 from March 12, 2010.
Then-Chief Judge Alex Munson scheduled for April 22, 2010 the start for bench trial against defendants Shixu Huang, Lihua Yi, Jingfan Zhang, Pingping Zhang, and Zhanshan Zhang.
Assistant U.S. Attorney Kirk Schuler is prosecuting the case while the defendants are being represented by court-appointed attorneys: Bob O’Connor/Michael Dotts, Bruce Berline, G. Anthony Long, Steven Pixley, and Mark Hanson.
The defendants have denied the charge of illegally entering Guam through Rota.
Through counsels, the parties said they understood that the U.S. government will present the case to the grand jury at it next session.
Should the grand jury return an indictment against the defendants, the stipulation stated, the government will move to dismiss the current charges in the information and the parties will make preparations for a jury trial on the charges in the indictment.
The parties further understood that should an indictment be returned against the defendants, a new trial date will be set with a new pretrial motions deadline, and any pretrial motions filed regarding the charges in the information may become moot.
