Severino U. Alforeza Jr., through attorney Joe Hill, sued in federal court Saipan Laulau Development Inc., Laolao Bay Golf Resort and “Doe 1,” jointly and severally.
The plaintiff is asking for general, compensatory and special damages to be proven at trial.
According to the complaint, a golf ball hit Alforeza’s chest on July 18, 2009 while he was in the process of lowering heavy metal rebars, approximately 20-ft. long, down to fellow workers reaching up for them from the bottom of the 20-ft. deep sewage facility excavation hole inside the golf course.
The golf ball, which an unknown golfer hit presumably from the 17th tee, struck Alforeza so hard he was knocked down to the ground, gasping for air, his complaint stated.
Alforeza said no agent or employees of the golf course helped him so he was forced to go on foot alone to the Commonwealth Health Center.
He later underwent surgery “to correct the inguinal hernia.”
As a result of the incident, Hill said his client wasn’t able to work for many days and suffered mental anguish.
The plaintiff can no longer perform strenuous labor because of his hernia, his lawyer added.
