Mohammed Yasin filed the complaint against Peter Go, also known as Peter Coelho, Empress Inc., doing business as 9922 Store, Empress Tours, Beijing Restaurant and Nic Health Store.
Represented by attorney Joe Hill, the plaintiff is asking the federal court to award him relief by ordering the defendant to pay his unpaid regular and overtime compensation for all hours he worked for, in an amount to be proven at trial, plus prejudgment interest, additional equal amount as liquidated damages, costs and reasonable attorney’s fees.
He is also asking the federal court to issue an order declaring that the defendant had violated the Fair Labor Standards Act, the Minimum Wage and Hour Act and the Nonresident Workers Act by failing to keep and maintain adequate records of hours he worked, and impose appropriate fines and sanctions.
The plaintiff stated that the manager, Go, a.k.a. Peter Coelho, hired him to work as a security guard at the newly opened tourist specially outlet in Garapan known as the 9922 Store on Feb. 7, 2007.
The plaintiff said the defendant sold products made and shipped in interstate commerce designed for sale to tourists.
He said the defendant used his services in taking products from the containers at the end of each business day, and work as security guard at the 9922 premises overnight.
According to the plaintiff, the defendant assigned him to a basic daily work schedule of 8-9 hours daily, seven days a week since Feb. 2007 until his final day of work on Dec. 31, 2008.
He said that for the whole period, the defendant failed to pay him his regular and overtime wages as required by law.
He filed three causes of action against the defendant for failure to pay regular and overtime wages, supplemental claim for unpaid regular and overtime wages, and for declaratory relief.
