Visiting Senior Judge Robert J. Bryan approved the stipulation of both parties.
This is the second time Quichocho’s sentencing has been postponed.
On May 10, 2010, both parties stipulated to reschedule the June 3 sentencing because “there are some new issues that may need to be addressed in the presentence report and also [Quichocho] is continuing to provide assistance to law enforcement and more time is needed before sentencing to determine the value of that assistance.”
Assistant U.S. Attorney James J. Benedetto is prosecuting the case while attorney Michael W. Dotts is representing Quichocho.
Prior to his sentencing, Quichocho was released to his wife Marvic as third party custodian.
Last February, Quichocho pleaded guilty to count two of the indictment for the offense of possession of a controlled substance with intent to distribute.
According to the factual basis of the plea agreement, Quichocho was in possession with intent to distribute .037 gram of “ice” on April 19, 2008.
Quichocho was arrested by the U.S. Drug Enforcement Administration and Tinian police on Nov. 10, 2009.
