In a 10-page motion, Dela Cruz through attorney Lilian A. Tenorio said “the family and personal relationships among Judge Inos, [Atalig], and [Atalig’s] counsel in this case suggest that a reasonable person, with knowledge of all circumstances, would harbor doubts about the judge’ impartiality.”
“Judge Inos, however, has not refused to recuse himself from these proceedings but has intimated to the mayor’s counsel that sanctions would be in order, should a motion to disqualify him be filed,” Tenorio stated.
The defendants in this case, according to Atalig’s attorney Robert Myers, “fail to meet the standard to require disqualification in this matter, and therefore, this court should deny the defendants’ motion and award costs for opposing it.”
