Associate Judge David A. Wiseman ordered Prisco Ongrung and Alfred Obak, both citizens of the Republic of Palau, to show up for a court hearing on Feb. 26.
Prisco has been convicted of four misdemeanors and one felony.
In his affidavit, Immigration investigator Nicolas T. Reyes stated that Ongrung entered a guilty plea to a traffic case in May 14, 1997 and was sentenced to 30 days imprisonment, all suspended except for three days, and one year probation.
On May 1, 2002, Ongrung was sentenced to a 10-day jail term and one year probation for another traffic case. He was again sentenced to jail for 30 days plus a year’s probation for another traffic case on May 10, 2006.
He pleaded guilty to another traffic offense on Dec. 11, 2007 and was sentenced to 60 days and one year probation.
Finally, he pleaded guilty to assaulting a federal officer and was committed to the Bureau of Prisons for a total of 90 days.
Obak, for his part, has been convicted to six misdemeanors including assault and battery on Aug. 24, 2005 where he was sentenced to one year jail term, all suspended except for three days, and one year probation.
He was sentenced to another six months jail term, all suspended and six months probation for disturbing the peace.
Obak entered a guilty plea to two charges of criminal trespass and one charge of theft on July 9, 2008. He was sentenced to six months jail term for each charge, all suspended and to be served consecutively except for four months. He was placed on supervised probation for two years.
Reyes stated that the two defendants did not comply with the terms and conditions of their entry to the CNMI and therefore are deportable aliens.
