
SUPERIOR Court Judge Joseph N. Camacho found probable cause to charge Nicko I. Martin and Mahabubur Rahaman in separate criminal cases following a preliminary hearing on Sept. 17, 2025.
Judge Camacho found probable cause to charge Martin with aggravated assault and battery, simple assault and battery, and disturbing the peace after hearing testimony from government witness Detective Britton Cruz.
On Sept. 8, the Department of Public Safety issued a wanted notice for Martin. He was later arrested in Kagman 3 without incident, and his bail was set at $20,000.
According to the complaint, the victim sustained blunt force trauma to his face, a concussion with loss of consciousness, and a fractured jaw.
The victim told investigators that he arrived at Xclusive Bar in Garapan on July 12 at midnight to drink with relatives. He said he had forgotten his betel nut bag in his vehicle. As he walked down the stairs, he saw Martin and shook his hand. When he turned around, he said Martin wrapped his forearm around the victim’s neck and began choking him.
The victim said he did not recall what happened next, but when he regained consciousness, he was on the ground and saw Martin kicking him in the face. He told police there were three or four other men with Martin, but he did not recognize them.
The victim also said Martin was a former Corrections officer and that they had had a minor altercation about three months ago. He asked his sister to take him to Martin’s residence, where Martin apologized for the “misunderstanding.”
Child abuse
Judge Camacho also found probable cause to charge Rahaman, 33, with child abuse, assault and battery, and disturbing the peace. Rahaman was accused of punching his four-year-old son and throwing him to the ground at their residence.
Both defendants were remanded to the custody of the Department of Corrections.
Martin was represented by Assistant Public Defender Molly Dennert, while Rahaman was represented by Assistant Public Defender Karie Comstock. Chief Prosecutor Chester Hinds and Assistant Attorney General Frances Demapan appeared for the government.
