Sylvio S. Ada is asking the Civil Service Commission to set aside the termination issued against him by Department of Community and Cultural Affairs Secretary Melvin O. Faisao.
Faisao terminated Ada for “reports” that he, Ada, deceived the government in getting travel authorization to Rota where he supposedly attended a “bogus” hearing in Dec. 2009.
Ada, whose family supported the Republican gubernatorial ticket in last year’s elections, had been working for the department for 17 years and was never accused of any wrongdoing.
His legal counsel, Robert T. Torres, said Faisao’s ground for termination “is unsupported, without basis, capricious motivated by personal or political animus and retaliatory conduct.”
“The case illustrates the very reason for the Civil Service Act and Personnel System Rules and Regulations to protect civil service employees from arbitrary conduct and political reprisals,” Ada’s appeal stated.
Torres asked the Civil Service Commission to consider Ada’s objections and recognize the deficiencies of Faisao’s actions.
The lawyer said there was no investigative report and Ada was never given a chance to review records from which his termination was based.
The appeal noted that the Office of the Personnel Management already gave weight to Ada’s response and advised Faisao to rescind the adverse action.
However, the DCCA secretary disregarded OPM’s recommendation.
Torres also requests the governor to sanction Faisao.
Ada manages two teams in the Saipan Little League and organizes other sports and youth activities in Kagman.
