Kerley denies disturbing the peace of girlfriend

A plea agreement was submitted, but Kerley, who already signed the document, chose not to accept it during his court hearing.

Kerley has been released from the custody of the Department of Corrections after posting a $1,000 unsecured bail following his Gerstein, or probable cause, hearing on May 13, 2011.

The prosecution said Kerley, who was drunk on May 12, 2011, yelled profanities at his girlfriend.

In the submitted plea agreement, the charge of disturbing the peace was stipulated as “crimes of domestic violence.”

Kerley is to be sentenced to six months imprisonment, all suspended, except for time served that will be credited, and to be placed on one year probation.

In lieu of community work service, the plea agreement states Kerley will “write a four-page essay, discussing the dangers of excessive alcohol consumption and its effects on health, relationship, and community.”

During his probationary period, Kerley will not consume any alcohol, and must attend and complete anger management counseling, alcohol and drug counseling/treatment, and any other counseling recommended by treatment provider or the Adult Probation Office.

The defendant will also pay a $100 fine to be paid in full prior to expiration of his probation, and all applicable court costs and probation fees.

Superior Court Judge Kenneth L. Govendo ordered Kerley to attend his court hearing for a status conference on June 14, 2011.

Assistant Attorney General Shelli Neal is prosecuting the case, while Assistant Public Defender Douglas Hartig was appointed as Kerley’s counsel.
