Man who pointed handgun at common-law wife gets 6 months

Superior Court Associate Judge David Wiseman also placed Aldan, 52, under supervised probation for three years under the Office of Adult Probation.

Wiseman directed Aldan to surrender the handgun that he used in assaulting his common-law wife.

The court ordered Aldan to pay a $500 fine, a $25 assessment fee, and a probation service fee to be determined by the probation’s office.

Aldan will also perform 100 hours of community work, the court said.

Aldan was further advised that “failure to comply with any of the…conditions shall constitute a violation of the terms and conditions of the suspended sentence and shall subject [him] to revocation proceedings,” Wiseman stated in his judgment and commitment order on Monday.

Aldan entered a guilty plea agreement, admitting assault, which led to the dismissal with prejudice of one count of assault with a dangerous weapon that carries a maximum 10-year jail term and a $10,000 fine, and one count of illegal possession of a firearm with a maximum penalty of five years imprisonment and a $5,000 fine.  

On July 2, 2009, Aldan pulled the trigger several times while pointing a handgun to his common-law wife’s forehand. The gun did not fire.

Aldan got mad after learning that his common-law wife and a female companion came home after playing poker.

Aldan signed on Nov. 2 the plea agreement with his attorney Jack Torres, and Assistant Attorney General George Hasselback.

Aldan is expected to be released on June 7, 2010.
